These Terms of Use ("Terms") govern your access to and use of nextgenlongevityhealth.com (the "Site"), operated by NextGen Longevity Health ("NextGen Longevity Health," "we," "us," or "our").
By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. The Site does not create a provider-patient relationship
Reading this Site, browsing the library, or submitting a consultation request does not create a physician-patient, provider-patient, or any other clinical or professional relationship between you and us or any provider affiliated with us.
A clinical relationship begins only when:
- You have completed our intake and consent process;
- A licensed provider has accepted you as a patient; and
- That provider is licensed in the state where you are located at the time of care.
Until all three are true, nothing on this Site is individualized medical advice, and nothing said to you in a pre-consultation conversation should be relied on as such.
2. Content is educational, not medical advice
Everything published on this Site — articles, program descriptions, the library, this page — is general educational information. It is not a diagnosis, not a treatment recommendation, and not a substitute for care from a qualified provider who has examined you and knows your history.
Do not use this Site to diagnose or treat a health problem. Do not start, stop, or change any medication, supplement, diet, or exercise program based on what you read here without first speaking to your own provider.
Our Medical Disclaimer is incorporated into these Terms by reference.
3. Emergencies
The Site is not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.
Our forms and email are not monitored continuously. Do not use them to report urgent symptoms. We do not guarantee that any message will be read within any particular time.
If you are in crisis or thinking about harming yourself, call or text 988 — the Suicide & Crisis Lifeline — available 24 hours a day in the United States.
4. Eligibility
You must be at least 18 years old to use the Site or submit information through it. By using the Site, you represent that you are 18 or older and legally able to enter into these Terms.
5. Consultation requests
Submitting a consultation request means you are asking us to contact you. It does not:
- Obligate us to accept you as a patient
- Obligate you to purchase anything
- Guarantee that any particular program, service, or treatment will be offered to you or is appropriate for you
We may decline to move forward for any lawful reason, including that our approach is not a good fit for what you need.
Information you provide must be accurate. Do not submit information about another person without their permission.
Do not include medical details in Site forms. Our forms are not a secure or appropriate channel for health information. Anything you send is at your own risk, and we may delete it.
6. Membership and payment
Membership terms — including pricing, billing frequency, what is and is not included, cancellation, and refunds — are set out in the membership agreement you receive before enrollment. That agreement controls if it conflicts with anything on this Site.
Prices displayed on the Site are subject to change. Membership fees cover only the services described in your membership agreement and do not include laboratory testing, medications, or third-party services unless expressly stated.
Membership is not health insurance. It does not replace health insurance and does not cover emergency, hospital, or specialist care.
7. No guarantee of results
Health outcomes vary. Nothing on this Site is a promise, guarantee, or warranty of any specific result. Any description of what a program is designed to support describes intent, not assured outcome.
Individual responses to any wellness or medical intervention differ based on genetics, adherence, baseline health, medical history, and factors outside anyone's control.
8. Intellectual property
The Site and its contents — text, articles, graphics, layout, program descriptions, logos, and the NextGen Longevity Health name and marks — are owned by us or our licensors and protected by copyright, trademark, and other laws.
You may view and print content for your own personal, non-commercial use. You may not reproduce, republish, distribute, modify, or create derivative works from Site content without our prior written permission.
9. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Attempt to access any non-public area of the Site or its systems
- Interfere with the Site's operation, security, or availability
- Use automated means to scrape, harvest, or collect data from the Site
- Impersonate any person or misrepresent your affiliation
- Upload malicious code
- Use Site content to train machine learning models without our written permission
We may suspend or terminate your access for any violation.
10. Content you submit
Anything you send us that is not personal or health information — feedback, suggestions, questions of general interest — may be used by us without restriction or compensation to you. Do not send us anything you consider confidential or proprietary.
Your personal information is handled under our Privacy Policy. Your health information, once you are a patient, is handled under our Notice of Privacy Practices.
11. Third-party links and services
The Site may link to third-party websites, tools, or resources. We do not control them, do not endorse them by linking to them, and are not responsible for their content, practices, or availability. Your use of any third-party service is governed by that party's terms.
12. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
We make no warranty that any information on the Site is current, complete, or applicable to your situation. Medical knowledge changes, and content may become outdated.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTGEN LONGEVITY HEALTH AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATED PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT — WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
Nothing in this section limits liability for professional negligence in the actual delivery of clinical care. This limitation applies to the Site, not to the practice of medicine. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless NextGen Longevity Health and its officers, members, employees, contractors, and affiliated providers from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
15. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction and venue there.
16. Changes to these Terms
We may modify these Terms at any time. Changes take effect when posted, with an updated "Last updated" date. Your continued use of the Site after that constitutes acceptance. If you do not agree to a change, stop using the Site.
17. General
Severability. If any provision is found unenforceable, the remainder stays in effect.
No waiver. Our failure to enforce any provision is not a waiver of it.
Entire agreement. These Terms, together with our Privacy Policy and Medical Disclaimer, are the entire agreement between you and us regarding the Site. Any separate patient or membership agreement controls over these Terms as to its subject matter.
Assignment. You may not assign these Terms. We may.
Survival. Sections 7 through 15 survive any termination.
